Fees for K1 Visas, K3 Visas, and Direct Consular Filings:
I charge non-refundable "flat rate" fees to process K1 visas, K3 visas, and direct consular filings. All my flat rate fees are based on the amount of work involved in processing each type of visa, and are competitive with other immigration attorneys performing similar work. I accept credit card payments at no extra charge in order to give my clients payment flexibility. For K1 and K3 visa cases, my fee is normally paid in two installments. For direct consular filings, the fee is normally paid in one installment. However, payment plans may be available to new clients for a small extra charge, provided they hold a major credit card (Visa, MasterCard, AMEX, or Discover) and agree to pre-scheduled credit card payments which will be charged automatically on the date due.
While standard flat rates will apply in most cases, if you or your fiancee or spouse have any special issues (such as multiple immigration filings in the past, prior immigration problems or a criminal history) the fee can be more. However, I will discuss any such problems (and their effect on my fee) with you at the outset of your case. Adjustment of Status Case Preparation:
After your fiancee receives their K1 visa, travels to the U.S., and you marry, or your spouse arrives using a K3 visa, they will need to file additional paperwork with the U.S. Citizenship and Immigration Service ("USCIS") to "adjust" their status and become a legal permanent resident. Clients who have had me prepare their K1 or K3 visa case can ordinarily retain me to prepare the necessary paperwork for their adjustment of status case for a discounted rate. Other potential clients can also contact me to discuss retaining me in their adjustment of status case.
Renewal of EADs and Advance Parole Travel Documents:
Although applications for an initial employment authorization document ("EAD") and advance parole document (if applicable) are included in my flat rate fee for adjustment of status, it is possible that your spouse may need to renew one or both of these types of documents prior to becoming a legal permanent resident. The forms to apply for a renewal of both of these benefits are fairly straightforward, and the USCIS now provides a way for customers to "e-file" them through its website. Former K1, K3, and adjustment of status clients are therefore welcome to contact me by phone or e-mail for guidance if they wish to file their renewal application on their own, free of charge.
Many clients nonetheless prefer the convenience of having me file their renewal applications for them. If you are a former client, you can normally retain me to file renewal applications for you at a low flat rate.
Removal of Conditions:
Many immigrating spouses are initially given "conditional" legal permanent resident status. This means that during the 90 days before the end of their second full year of conditional legal permanent resident status, they will have to file a petition to remove the condition.
Former K1 visa, K3 visa, direct consular filing, and adjustment of status clients can hire me to prepare a removal of condition petition for them at a discounted rate. Potential clients who have not hired me to represent them before can nonetheless contact me about preparing a petition to remove conditions.
Naturalization:
Spouses of U.S. citizens are eligible to become a naturalized citizen after being a legal permanent resident for three years, and can file an application for naturalization up to three months before they become eligible to naturalize. Former clients can normally hire me to prepare their naturalization application for a discounted rate.
